Commodity Traded to Dealerships:
For grain to be used as trade-in on vehicles, the grain must have been produced by the farmer and owned by the farmer/dealer at the time of the trade-in. This means the grain must be stored in the patron’s name or delivered in the name of the dealership. If grain has been delivered but not stored. Ownership has passed and it is too late for the farmer to use grain as trade-in and avoid sales tax. The patron cannot have a lien on the grain either. If grain has been delivered as farm to terminal it changed ownership when it passed over the destination scale and it is too late to be used as trade-in to avoid sales tax.
If patron buys grain to use as a trade-in. we must charge the patron sales tax on the grain because it is not being purchased for Agricultural purposes.
